Terms and Conditions

Article 1 - Definitions

In these terms and conditions shall apply:

  1. Entrepreneur: VuurSfeerhaard, located at Handelskade 2, 7202CD Zutphen, Chamber of Commerce 82995516.
  2. Consumer: the natural person who is not acting for purposes relating to his trade, business, craft or profession.
  3. Distance contract: an agreement concluded between an entrepreneur and a consumer via an organised distance selling system.
  4. Product: electric fireplaces and related products offered by entrepreneurs.
  5. Reflection time: the period within which the consumer can make use of the right of withdrawal.
  6. Right of Withdrawal: the option for the consumer to cancel the agreement within the cooling-off period.
  7. Durable medium: any means that enables the consumer to store information for future use.

Article 3 - Applicability

  1. These general terms and conditions apply to every offer and every agreement between entrepreneur and consumer.
  2. Deviations are only valid if agreed in writing.
  3. If one or more provisions prove to be null and void or voidable, the remaining provisions shall remain fully in force.

Article 4 - The offer

  1. The offer contains a clear and complete description of the products.
  2. Images are for illustrative purposes only. Slight variations may occur.
  3. Obvious errors or mistakes do not bind the entrepreneur.

Article 5 - The Agreement

  1. The agreement is concluded at the moment of acceptance by the consumer.
  2. After ordering, the consumer receives a confirmation by e-mail.
  3. The entrepreneur may refuse an order if there are valid reasons for doing so.

Article 6 – Reflection period and right of withdrawal (30 days)

  1. The consumer has the right to terminate the agreement within 30 days to terminate without giving reasons.
  2. The cooling-off period starts on the day after the product has been received.
  3. During the cooling-off period, the consumer must handle the product with care.

Article 7 – Exercise of the right of withdrawal

  1. Revocation must be notified in writing or by e-mail within the cooling-off period.
  2. The product must be returned within 30 days after revocation to be returned.
  3. Return costs are the responsibility of the consumer.
  4. In case of damage or use that goes beyond what is necessary, depreciation may be charged.

Article 8 – Refund

  1. After receipt of the return shipment, the purchase amount will be refunded 30 days refunded.
  2. Refunds will be made via the same payment method, unless otherwise agreed.

Article 9 - Exclusion of right of withdrawal

The right of withdrawal is excluded for:

  1. Custom made or specially composed products;
  2. Products that cannot be returned to their original condition after installation;
  3. Products that are no longer saleable due to use.

Article 10 – Sound and operation of electric fireplaces (IMPORTANT)

  1. Electric fireplaces contain electronic and mechanical components such as fans, power supplies and motors.
  2. During use, a light to audible sound occur, including buzzing, clicking or fan noise.
  3. This sound is a normal and inherent part of the operation of an electric fireplace.
  4. Producing such sound constitutes no shortage, no defect en no non-conformity.
  5. Noise from normal use no right of cancellation, replacement or refund.
  6. When purchasing, the consumer declares that he or she is aware of this product feature.

Article 11 – Prices

  1. All prices include VAT.
  2. Price changes after ordering do not apply.
  3. Any shipping costs will be clearly stated in advance.

Article 12 - Delivery

  1. Delivery will take place at the address specified by the consumer.
  2. Delivery times are indicative. Delays do not automatically entitle you to cancel your order.
  3. The risk passes to the consumer upon delivery.

Article 13 – Warranty and conformity

  1. The entrepreneur guarantees that products comply with the agreement.
  2. The warranty does not apply to improper use, assembly errors or normal wear and tear.
  3. Additional warranties do not affect statutory rights.

Article 14 - Liability

  1. The entrepreneur's liability is limited to the purchase price of the product.
  2. The entrepreneur is not liable for consequential or indirect damage.

Article 15 - Payment

  1. Payment must be made via the payment methods offered.
  2. In the event of late payment, the consumer owes statutory interest and collection costs.

Article 16 - Complaints

  1. Complaints must be reported in writing within a reasonable period of time.
  2. The entrepreneur aims to answer complaints within 14 days.

Article 17 - Disputes

  1. All agreements are exclusively governed by Dutch law.
  2. Disputes will initially be resolved by mutual agreement.
  3. If no solution is reached, the dispute will be submitted to the competent court in the Netherlands.

Article 18 – Amendment of general terms and conditions

  1. The entrepreneur may change these conditions.
  2. Amended terms and conditions apply from the moment they are published on the website.
