Terms and Conditions
Article 1 - Definitions
In these terms and conditions shall apply:
- Entrepreneur: VuurSfeerhaard, located at Handelskade 2, 7202CD Zutphen, Chamber of Commerce 82995516.
- Consumer: the natural person who is not acting for purposes relating to his trade, business, craft or profession.
- Distance contract: an agreement concluded between an entrepreneur and a consumer via an organised distance selling system.
- Product: electric fireplaces and related products offered by entrepreneurs.
- Reflection time: the period within which the consumer can make use of the right of withdrawal.
- Right of Withdrawal: the option for the consumer to cancel the agreement within the cooling-off period.
- Durable medium: any means that enables the consumer to store information for future use.

Article 3 - Applicability
- These general terms and conditions apply to every offer and every agreement between entrepreneur and consumer.
- Deviations are only valid if agreed in writing.
- If one or more provisions prove to be null and void or voidable, the remaining provisions shall remain fully in force.
Article 4 - The offer
- The offer contains a clear and complete description of the products.
- Images are for illustrative purposes only. Slight variations may occur.
- Obvious errors or mistakes do not bind the entrepreneur.
Article 5 - The Agreement
- The agreement is concluded at the moment of acceptance by the consumer.
- After ordering, the consumer receives a confirmation by e-mail.
- The entrepreneur may refuse an order if there are valid reasons for doing so.
Article 6 – Reflection period and right of withdrawal (30 days)
- The consumer has the right to terminate the agreement within 30 days to terminate without giving reasons.
- The cooling-off period starts on the day after the product has been received.
- During the cooling-off period, the consumer must handle the product with care.
Article 7 – Exercise of the right of withdrawal
- Revocation must be notified in writing or by e-mail within the cooling-off period.
- The product must be returned within 30 days after revocation to be returned.
- Return costs are the responsibility of the consumer.
- In case of damage or use that goes beyond what is necessary, depreciation may be charged.
Article 8 – Refund
- After receipt of the return shipment, the purchase amount will be refunded 30 days refunded.
- Refunds will be made via the same payment method, unless otherwise agreed.
Article 9 - Exclusion of right of withdrawal
The right of withdrawal is excluded for:
- Custom made or specially composed products;
- Products that cannot be returned to their original condition after installation;
- Products that are no longer saleable due to use.
Article 10 – Sound and operation of electric fireplaces (IMPORTANT)
- Electric fireplaces contain electronic and mechanical components such as fans, power supplies and motors.
- During use, a light to audible sound occur, including buzzing, clicking or fan noise.
- This sound is a normal and inherent part of the operation of an electric fireplace.
- Producing such sound constitutes no shortage, no defect en no non-conformity.
- Noise from normal use no right of cancellation, replacement or refund.
- When purchasing, the consumer declares that he or she is aware of this product feature.
Article 11 – Prices
- All prices include VAT.
- Price changes after ordering do not apply.
- Any shipping costs will be clearly stated in advance.
Article 12 - Delivery
- Delivery will take place at the address specified by the consumer.
- Delivery times are indicative. Delays do not automatically entitle you to cancel your order.
- The risk passes to the consumer upon delivery.
Article 13 – Warranty and conformity
- The entrepreneur guarantees that products comply with the agreement.
- The warranty does not apply to improper use, assembly errors or normal wear and tear.
- Additional warranties do not affect statutory rights.
Article 14 - Liability
- The entrepreneur's liability is limited to the purchase price of the product.
- The entrepreneur is not liable for consequential or indirect damage.
Article 15 - Payment
- Payment must be made via the payment methods offered.
- In the event of late payment, the consumer owes statutory interest and collection costs.
Article 16 - Complaints
- Complaints must be reported in writing within a reasonable period of time.
- The entrepreneur aims to answer complaints within 14 days.
Article 17 - Disputes
- All agreements are exclusively governed by Dutch law.
- Disputes will initially be resolved by mutual agreement.
- If no solution is reached, the dispute will be submitted to the competent court in the Netherlands.
Article 18 – Amendment of general terms and conditions
- The entrepreneur may change these conditions.
- Amended terms and conditions apply from the moment they are published on the website.
